Telekom does not have to offer a wholesale flat rate
Today Telekom won an important victory in the dispute over the wholesale flat rate before the Higher Administrative Court in Münster. The court has decided that Telekom does not have to offer its competitors a wholesale flat rate for a fixed monthly price for the time being. In November, the regulatory authority obliged Telekom to pay this flat rate.
Telekom sued this decision and demanded it a suspension of the obligation pending a final decision. The court now complied with this request. The decision of the court was mainly influenced by the discontinuation of the T-Online ISDN flat rate for 79DM on March 1st. The price-cost gap between T-Online and the competition no longer exists, so that a wholesale flat-rate is no longer necessary. It is still unclear when a final decision will be reached in the pending lawsuit at the administrative court in Cologne. In any case, the Telekom concept has worked so far. Before you have to offer the competition a wholesale flat rate, you should rather set the flat rate. As with any profit-oriented company, what this means for the customer comes second. Even if it is not in the customer's interest, Telekom's move is completely understandable from an economic point of view. Who wouldn't act like this if they were you?
